Welcome to SideCar Leads, a product of Addison Myers Group LLC. By using our website (sidecarleads.com), affiliated landing pages, and services, you agree to be bound by the following Terms and Conditions ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing or using our Site or purchasing services (including leads), you agree to be legally bound by these Terms, our Privacy Policy, and any additional terms referenced herein. If you do not agree, you may not use our services.

2. Our Services

SideCar Leads operates a lead generation platform that collects consumer information and sells individual leads to licensed insurance agents and agencies. Leads are matched on a one-to-one basis and may be delivered via email, text, CRM integration, or dashboard.

We also create and manage localized landing pages, including DBA-branded websites, to attract and convert insurance leads. These sites may display agent names, photos, and license numbers.

3. Use of Agent Information

If you are a participating insurance agent:

• You agree to allow SideCar Leads to use your name, contact details, license number, and public-facing branding on lead landing pages, including those branded as local or independent agencies.
• You affirm that you are a properly licensed agent in the states where you receive leads.
• You authorize us to display your information to consumers for the purpose of creating a one-to-one match.
• Featured agent display. As an active enrolled agent on the SidecarLeads platform, your name, photo, NPN, bio, and licensed states may be displayed publicly on sidecarleads.com to showcase the professionals in our network. This display is intended to demonstrate to prospective agents the quality of our network and does not constitute an endorsement of any specific product or carrier.
• You may request removal from specific DBAs, branding formats, or the public agent showcase by contacting support.

Agents featured on sidecarleads.com are independent licensed professionals and are not employees or representatives of SidecarLeads or Addison Myers Group LLC.

4. Lead Sales and Delivery

• All leads are exclusive and sold to one agent per match.
• Leads are delivered in real time and may include consumer name, contact information, and responses to qualifying questions.
• You are responsible for reviewing and acting on leads promptly.
• We make no guarantee of conversion, sales performance, or responsiveness of leads.

5. Refunds and Billing

• Due to the digital nature of our services, all lead sales are final unless otherwise stated in writing.
• Billing is processed via secure third-party providers.
• If you believe a lead is invalid (e.g., fake contact info, out-of-territory), you must report it within 72 hours for review. Approved credit decisions are made at our sole discretion.

6. Acceptable Use

You agree not to:

• Use our services for any illegal, deceptive, or unauthorized purpose
• Misrepresent yourself as a consumer to test leads or scrape data
• Copy, reverse-engineer, or duplicate our landing pages or software
• Spam, harass, or mislead any leads delivered to you

Violation may result in account suspension or legal action.

7. Intellectual Property

All content on our Site and landing pages — including logos, copy, design, software, and trademarks — is the property of SideCar Leads or its licensors. You may not use, duplicate, or distribute our content without express written permission.

8. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind. We do not guarantee the accuracy, completeness, or effectiveness of any lead or marketing result. You use our platform at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, SideCar Leads and its affiliates shall not be liable for any indirect, incidental, punitive, or consequential damages, including loss of revenue, data, or reputation arising out of your use of our services.

Our total liability for any claim shall not exceed the total amount paid by you for leads in the previous 30 days.

10. Termination

We reserve the right to terminate your access to our platform at any time, with or without cause, including but not limited to breach of these Terms, misuse of leads, or fraud.

11. Modifications

We may update these Terms at any time. Continued use of our Site or services after changes means you accept the revised terms. You are responsible for reviewing this page periodically.

12. Governing Law

These Terms shall be governed by the laws of the State of North Carolina, without regard to its conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Buncombe County, NC.

13. Agent Matching and Licensing

We work to connect consumers with a locally licensed insurance agent who can serve their needs.

Definition. For purposes of these Terms, a locally licensed agent means an insurance professional who holds a valid, active license to conduct insurance business in the consumer's state. This includes agents physically located in the consumer's area, agents located elsewhere in that state, and agents based outside that state who are licensed to service it.

Matching process. We attempt to match consumers with a locally licensed agent serving their specific city or area. We do not guarantee a match with an agent in the consumer's immediate locality. Where an agent in a specific area is not available, we may connect the consumer with another locally licensed agent who is licensed to serve their state.

Network expansion. Our agent network is continually expanding, and we are actively adding locally licensed agents in additional markets. Agent availability in any given area may change over time.

We do not guarantee that any match will be made, that an agent will contact you, or that any particular product, rate, or coverage will be offered or available to you. We are not an insurer and do not provide insurance advice.
